Comments: FEMA should be aware that a number of the neighbors living immediately adjacent to the school, as well as the Upper Audubon Association, have filed suit against the Board of Zoning Adjustments for the City of New Orleans, the N. O. Dept. of Safety & Permits and the City, concerning the failure to satisfy the requirements for the zoning variance that was improperly granted by the BZA. A hearing on the matter is currently set in Civil District Court, Division D (Judge Medley) on Friday, June 22, 2012 at 9 a.m. Most of the neighbors do not oppose the renovation of Audubon Charter School, however, many (if not most) are opposed to the complete lack of candor and honesty demonstrated by the administration of the school (the charter operator) in meeting and addressing the very real and valid concerns the neighborhood has with regard to traffic flow, traffic-related safety issues, traffice congestion, long-standing problems with illegal parking by the charter operator's employees and parents walking their children into and out of the school, and on and on. The charter operator refuses to agree to institute a drop-off process such as employed by other schools operating in residential Uptown neighborhoods (e.g., Lusher, Sacred Heart, McGhee, etc). FEMA should stop this process from going further unless and until the neighborhood's concerns are addressed in a manner that will be enforceable in court if the school fails to live up to its promises to address these concerns.
